Acceptance of Terms

By accessing or using OptiTalent ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service. The Service is operated by OptiTalent, based in Brisbane, Queensland, Australia.

Description of Service

OptiTalent provides AI-powered recruitment tools including candidate matching, resume parsing, commission tracking, and related services. The Service is designed for recruitment professionals and agencies.

Accounts

You are responsible for maintaining the security of your account credentials. You must provide accurate, current information when creating an account. One person or legal entity per account unless on a team plan.

Acceptable Use

You agree to use the Service only for lawful recruitment purposes. You may not:

• Upload data you do not have the right to process
• Use the Service to discriminate against candidates based on protected characteristics
• Attempt to reverse-engineer, decompile, or extract our AI models
• Exceed reasonable usage limits or abuse API access
• Resell or redistribute access to the Service without written consent

Data Ownership

You retain ownership of all data you upload to the Service, including candidate resumes, job descriptions, and related content. We do not claim ownership of your data. We process your data solely to provide the Service.

AI-Generated Content

The Service generates AI-powered analyses, scores, and recommendations. These are provided as decision-support tools and should not be the sole basis for hiring decisions. You are responsible for final hiring decisions and compliance with anti-discrimination laws.

Availability & Support

We strive for 99.9% uptime but do not guarantee uninterrupted access. Planned maintenance will be communicated in advance. Support is available via email during AEST business hours.

Payment Terms

Paid plans are billed in AUD. Pricing is as displayed on our pricing page at the time of purchase. We reserve the right to change pricing with 30 days notice. Early access users will be notified before any pricing changes affect them.

Termination

Either party may terminate at any time. Upon termination, you will have 90 days to export your data. After this period, data may be permanently deleted. Refunds for annual plans will be prorated.

Limitation of Liability

To the maximum extent permitted by Australian law, OptiTalent's liability is limited to the fees paid by you in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

Governing Law

These Terms are governed by the laws of Queensland, Australia. Any disputes will be resolved in the courts of Queensland.

Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or in-app notification at least 30 days before they take effect.
